- Given cost on website is estimated, based on lowest hotel rates existing as of now. We do not hold any confirmation for hotels. Hotels are subject to availability at the time of booking. Any difference in cost shall be intimidated to the guests before the booking confirmations.
- In hill station places (like Shimla, Manali, Nainital, Kausani, Munnar, Thekkady, etc) the AC facility will not be there in the rooms. There may be additional heater charges during winter season.
- Room rates are based on standard (base category) rooms. Supplement cost will be applicable for valley facing or higher category rooms.
- Standard check-in time at hotel is 14:00 hrs & check-out time is 11:00 hrs.
- All transfers are based as per tour itinerary (point to point) & vehicle is not on disposal basis.
- Breakfast will start from Day 2 of the itinerary.
- Portages and Driver Tips are to be paid extra.
- Optional sightseeing has to be booked in advance on your own by paying an additional cost.
- There is no refund for any unutilized services.
- All rates mentioned are per person on double sharing basis.
- On hilly areas the Vehicle AC will not be operational.
- During sightseeing the vehicle will go up to permissible point only, any further arrangement to be made by guests and all extra expenses will be borne by the guests.
- Extra bed in the room means only extra mattress (no cot).
- Picture Holidays reserves the right to pass on any increase in rates caused by the changes in local, state, or federal taxes before the commencement of the tour.
- Date changes of tours are not allowed. It will be treated as cancellation & accordingly the cancellation charges will be applicable.
- If accommodation is not available in the specific hotel for the particular package tour due to reasons beyond our control, we shall make our best efforts to shift the guests to hotel maintaining or having more or less the same standard. No complaint or claim shall be made by the guests in this respect.
- If there is any delay in ferry/train/airline or it is cancelled, Picture Holidays is not responsible for any compensation for hotels, meals, sightseeing or any other claim.
- Expenses caused by factors beyond our control like ferry/train/flight delays, roadblocks, political disturbances etc. will be borne by the guests.
- Rates are not valid during peak season & festive period. Supplement cost will be applicable for the peak season & festival period. Guests will be intimidated about the difference of rates before confirmation.
- We will request for early check-in or late check-out without any additional cost (subject to availability)
- Immediate assistance and change of vehicle will be arranged within minimum humanly possible time in case of car break down.
- Clients need to report at their hotel lobby for city tours / transfers on prescribed time schedules, in case of delay, the same will be missed and we shall bear no responsibility to the same and no refunds will be made against such unutilized services.
- We recommend on purchasing Travel Insurance for all the travellers for the tour.
- Child below 5 years will be complimentary. However in some cases hotel may prefer to charge as per their policy.
PAYMENT POLICY:
- Booking Amount: (In case of non-refundable hotel bookings full payment will be required)
- Airfares: 100% payment as booking amount
- Hotels: 100% payment as booking amount (On non-refundable hotel bookings)
- Hotels: 50% payment as booking amount (On refundable hotel bookings)
- Tour Packages: 50% payment as booking amount (PART 1)
- Tour Packages: 100% payment before 30 days from tour commencement date (PART 2)
CANCELLATION POLICY: (Charges may vary if hotel policy is different, same will be intimidated)
- Tour Cancellation before 45 days: 30% charges (PART 1)
- Tour Cancellation before 30 days: 50% charges (PART 2)
- Tour Cancellation before 20 days: 100% charges (PART 3)
- All cancellations must be requested to us in writing on our official e-mail address.
- Applicability of the aforementioned policies and determination of fulfilment of eligibility criteria shall be at the sole discretion of Picture Holidays. You agree and acknowledge that Picture Holidays decision on this matter shall be final and binding on you.
- Picture Holidays reserves the right to amend, suspend and/or terminate this policy or any part thereof or to make changes to these Terms and Conditions, at any time and at its sole discretion without prior notice or liability to the Customer. The Terms and Conditions that are in effect at the time of booking will determine your eligibility under this policy.
- You agree and acknowledge that any dispute arising out of or in connection with this policy shall be subject to the exclusive jurisdiction of courts in Mumbai, India.
- By applying to avail claims under this policy or any of its constituent policies, it shall be deemed that you have understood and voluntarily agreed to all the terms and conditions stated herein.
- www.pictureholidays.com is the official web site of Picture Holidays, with a registered office in Mumbai.
- Information given on the web site is verified and updated periodically by Picture Holidays. It is understood that the viewer has gone through the information provided therein and has arrived at a decision to go ahead with the booking.
- Picture Holidays cannot be held responsible for any loss or inconvenience caused because of the short fall in the services provided by the service provider. Our packages are designed to give flexibility to suit the purse and purpose of our clients.
- FIT accommodations, transport arrangements where required and optional tours are the main components of any holiday package. Booking of any one or more of these components signifies acceptance of the terms and conditions stated therein.
- Travelers are solely responsible for obtaining valid travel documents and information pertaining to laws and customs of their destination. Picture Holidays is not responsible for any charges, fees or penalties that subsequently may be imposed by any government agency or for charges incurred due to incomplete or incorrect travel documents.
CHILD POLICY:
- Child policy varies from hotel to hotel. At the time of booking, the number of children accompanying parents should be clearly specified along with details of their age to avoid any embarrassing situation at the time of check-in.
CHECK IN / CHECK OUT TIME:
- Check-in and check-out timings vary from hotel to hotel. If client arrives at the hotel before the check-in time and needs accommodation immediately on arrival, the room should be booked from the previous night. If client wishes to depart after the check-out time, the hotel / resort is entitled to collect additional charges as per their rules, directly from the client.
COMPLAINTS / COMMENTS:
- It is imperative that any complaints regarding services not provided as per contract are immediately lodged with the provider agency (Hotel/ Transport Agency) with a copy to us to initiate appropriate action.
REFUNDS:
- Requests for refund should be made in writing within 14 days after the scheduled completion of the services. Refund requests for curtailed stays cannot be processed unless provided with supporting documentary evidence from the supplier. Any claims for refund are governed by the policy and guide lines of the concerned service provider. The supplier reserves the right to decide the quantum of refund and charge an administrative fee where necessary.
- Refunds are made only after receiving the same from our suppliers. No refund can be given without this. No refunds on partially un-utilized services and no-shows.
RESPONSIBILITY:
- It is understood that, Picture Holidays acts as only an agent of the various services providers involved. As such, it cannot be held responsible for delay or any change in the itinerary necessitated by flight delays, heavy rain, floods, traffic jams, etc., and any loss, injury or damage caused by fire, breakdown of machinery, equipment or vehicles, or strikes, civil disturbances, riots, thefts, pilferage, epidemics, quarantines etc. and consequent extra expense the passenger may have to incur as a result of any of the forgoing causes.
- Further, Picture Holidays does not operate, own or control any means of transportation, sightseeing and accommodation and therefore cannot assume any liability in case of injury loss, damage, delay or accident, delay or irregularity which may be caused by defect of any supplier or for any reason whatsoever, or through acts of default of any supplier or company or person engaged in providing the services.
ACCURACY:
- Although every effort has been made to ensure the accuracy of the information at the time of uploading on the website, we cannot accept responsibility for any errors or omissions and reserve the right to vary, amend or cancel any of the arrangements featured in this web site should we find such alternatives necessary. We will of course do our best to inform you of changes, but prices may be subject to change without notice as well as ownership.
- The details and information included in the tariff are subject to change and Picture Holidays cannot be held liable for any, loss, disappointment, or other damage caused thereby.
LAW & JURISDICTION:
- For all complaints, suits, claims or disputes of whatsoever nature relating to any products by Picture Holidays and third party products and tours shall be subject to the exclusive jurisdiction of courts in Mumbai, India.
PAYMENT:
- Payments should be made in the name of Picture Holidays by CHEQUE / NEFT/ RTGS / IMPS. Payment by DD can be drawn at our cost. In unavoidable circumstances, cash payments are accepted as per government guidelines only. We also accept credit cards/debit cards. There will be a surcharge of 2% on card payments which will be added to the total invoice cost.
IF YOU CANCEL YOUR HOLIDAY:
- If you or any member of your party wishes to cancel your holiday, you must notify us in writing only. In any case, the date of cancellation will be at the date on which notice is received by us. The person who signed the confirmation form must also sign the letter of cancellation. As this incurs administrative costs and we may not be able to resell your booking, cancellation charges will apply.
IF YOU CHANGE YOUR BOOKING:
- If, after your confirmation, invoice has been issued and you wish to change your travel arrangements in any way, for example your chosen departure date, names of passengers or accommodation, we will do our utmost to make these changes, but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking. You may also be asked to pay an administration charge of per person per change and any further costs we incur in making this alteration. You should be aware that these costs could increase the closer to the departure date that changes are made and you should contact us as soon as possible.
SCOPE OF ACTIVITY:
- We are travel and holiday organisers only. We do not control or operate any airline, neither do we own or control any shipping company, coach or coach company, hotel, transport, restaurant, kitchen caravan or any other facility. Though we take care in selecting all the ingredients in your holiday, we can only select and inspect them. As we have no control in running of them, we cannot be responsible for any delay, improper services provided by any agency, airline, transport, hotel, any provider of services, for any injury, death, loss or damage which is caused by the act or default of the management or employees of any hotel, airlines, shipping companies, cruise, coach owners/coach operators/tour operators who are the company’s independent contractors. We are also not responsible for the delay or deficiency in services provided by agency, airline, transport, hotel, any provider of services, and/or any act or actions of co-travelers, co-passengers which may result in injury, damage to the life or property of the client or interfere with enjoying or availing the following and /or the other services to be provided on the tour. We do take all reasonable steps in ensuring that the organization maintains standards and provide a service that is acceptable to the company.
TRAVEL DOCUMENTS AND CLEARANCES:
- It shall be sole responsibility of the Clients to hold valid travel documents and statutory clearances, to enable you to travel on the Tour such as passports, insurance and medical insurance certificates and other statutory certificates including immigration clearance. In any case, your Passport must be valid for at least six months subsequent to the scheduled departure date of the tour.
- As granting or rejecting visas and immigration clearance is the sole prerogative of the concerned sovereign governments, the Operator shall neither be responsible in case of non-granting of such documents nor liable for any delay, denial or other related act/omission or for any loss, expense, damage or cost resulting there from. The position in respect of cancellation of Tour by Client due to non-availability of travel documents would not change only by virtue of the Client having applied for such documents through us. Even if visas are rejected, our stipulated fees shall be payable by the Client. There will be no refund to the Client, or any member of his party, is unable to travel due to the said reasons. In such cases, the non-refundable deposit paid by the clients shall be forfeited and no claim whatsoever shall be made for the same.
- In the event that a client is unable to travel on the tour originally booked by him/her, due to rejection of visas by the concerned embassy, the said client shall have the option to postpone his/her tour to any other future date or transfer his tour to any other tour and in such case the transfer fee for the transfer of the tour shall apply. However, if the client books and pays within the cancellation period and is unable to travel due to any reason whatsoever including non-availability of visas or any travel documents, the cancellation policy will apply.
HEALTH AND INSURANCE:
- It shall be the duty of the Client to inform the Company incase the Client has any medical condition that may affect his ability to enjoy and pursue fully the Tour Arrangements and wherein the interest of the Group or any member thereof is prejudicially affected.
- The Company reserves the right to ask the Client to provide written certification of his medical fitness before departure. In the event that a medical condition has not been disclosed the Company will not be liable to provide any assistance or money back.
- The Company makes it a condition that the Client is adequately covered by Overseas Mediclaim Insurance Policy and other appropriate insurance policies from the Insurance Company identified and named by us to cover the risk of life, limb and property while on tour, as Picture Holidays will not be responsible for the same.
- It may be noted that the tour cost may or may not include the insurance premium and that the clients shall have to acquire the same at their cost.
LIABILITY:
- In the event of the Company exercising its rights to amend or alter any Tour or holiday advertised in their Brochure/ itinerary after such Tour or Holiday has been booked, the Client shall have the right:
To continue with the Tour or holiday as amended or altered;
Or to accept any alternative Tour or holiday, which the company may offer. In either of these above cases the Client shall not be entitled to or the company shall not be liable to the client for any damage, additional expenses, consequential loss suffered by him or to pay any amount as refund. In the event that the Company is unable to conduct a particular Tour, the Company shall at its own discretion, refund the amount of the cost of the said Tour to the Client (after deducting the actual expenses incurred by us on your booking like visa, insurance premium, POE charges, and other overheads as applicable from case to case) without any interest on the same. The Client will not be entitled to make any grievance thereafter in respect of the same.
- The Company shall, in no circumstances whatsoever is liable to the client or any person traveling with him for any death, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss and/or damage or any kind of theft howsoever caused;
- Any act, omission, default of any independent Contractor or other person or by any servant or agent employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the client or for any person traveling with him howsoever caused.
- The temporary or permanent loss of or damage to baggage or personal effects howsoever caused including wilful negligence on the part of any person.
- Loss of baggage by the airlines / coach / cruise / train.
- Overbooking of seats by the airline.
- Failure on the part of airline to accommodate passengers despite having confirmed tickets or change of route.
- If in the event that the Client is booked on a particular airline and the said flight is over booked/cancelled for whatever reason and the Client is not allowed/able to board the flight, the Client shall not hold the company responsible for the same and no claim whatsoever can be made by the Client against the company for refund or compensation.
- The Company shall not be responsible and / or liable for any damages caused to the Client due to reasons beyond the control of the Company (Force Majeure / Vis Majeure).
- In any case, no liability on the part of the Company arising in any way out of this contract in respect of any tour, holiday, excursion facility shall exceed the total amount paid for the tour holiday, and shall in no case include any consequential loss or additional expense whatsoever
CONDITIONS OF TRAVEL:
- The Client will have to strictly follow the Tour Program and return to India as per the validity of the air ticket. There shall be no refund, if the client fails to join the group at the commencement of the tour, or joins the group later or leaves the group before culmination of the tour. It shall be noted that for all purposes, it shall be the responsibility of the Client to reach the place of commencement of the Tour and register with the representative of the company at the appointed place, date and time. In case if a client along with his family is compelled to discontinue the tour due to any reason whatsoever including illness, death or loss of passport or any travel documents, no claim shall be entertained for refund of unutilized services. Even if a client is unable to reach the place of commencement of the tour due to any reason whatsoever including loss of baggage or loss of travel documents, his booking shall be treated as “no show” on the tour and 100% cancellation charges will be levied. If a client avails pre – tour services or part thereof, or the air tickets (cost of which is included in the main tour cost) but fails to join the group for the main tour at the appointed place, or cancels the tour after using the air tickets; tour arrangements or part thereof, it shall be treated as “no show” and there will be no refund whatsoever for the unutilized pre-tour or main tour services.
- Picture Holidays reserves the right to withdraw tour membership from anyone whose behaviour is deemed likely to affect the smooth operation of the tour or adversely affect the enjoyment or safety of other passengers Picture Holidays shall be under no liability to any such person. It is hereby declared that the immunities provided under this contract shall be available to the Company’s Managers, including Tour Managers, Employees, Servants and Agents but not to the Independent Contractors selected by the Company.
- Each of these conditions shall be severable from the other and if any provision be invalid, illegal or unenforceable, the remaining provisions shall nevertheless have full force and effect. No liability on the part of the Company arising in any way out of the Contract in respect of any tour, holiday, excursion facilities shall exceed the total amount paid or agreed to be paid for the tour holiday, and shall in no case include any consequential loss or additional expense whatsoever.
- If no suit/action is brought against the Company within two months of the last day of the Tour, the Company shall be discharged from all liabilities under/or arising out of this Contract and the Client shall be deemed to have relinquished/abandoned all his rights under or arising from this Contract.
- If you book with a travel agent and your booking with that agent includes, but is not limited to Picture Holidays arrangements, your contract is with your travel agent and Picture Holidays is simply a supplier to your travel agent.
- In case of publication of any travel scheme offering any discount or benefit by the Company, it shall have the sole right to withdraw such a scheme or discount at any time unless a specific assurance of the contrary is published.
